Terms and Conditions of Use
Welcome to MyDirectives.care!
These Terms and Conditions of Use (Terms) refer to MyDirectives, Inc. as MyDirectives, we, us, or our. The Terms control your access to and use of websites, applications, products, and services we provide. This includes MyDirectives.care and our services that allow you to create, upload, securely store, manage, and share advance directives and other advance care planning (ACP) documents. We refer to these products and services collectively as the MyDirectives Services.
Please read these Terms carefully. By creating a MyDirectives.care account or accessing or using the MyDirectives Services, you acknowledge that you have read and understood these Terms and agree to be bound by them.
If you do not agree to these Terms, you should not create a MyDirectives.care account or use the MyDirectives Services.
Who May Use MyDirectives.care
You must be at least 18 years old to create a MyDirectives.care account.
Your MyDirectives.care Account
You may use MyDirectives.care only in compliance with these Terms and applicable laws and regulations.
You agree that information you provide through MyDirectives.care will be accurate and complete to the best of your knowledge. You are responsible for reviewing and updating your information and ACP documents as your circumstances and healthcare decisions change.
You are responsible for maintaining the confidentiality and security of your account credentials. You are also responsible for activity that occurs through your account.
You may not allow another person to use your account credentials or impersonate another person when using MyDirectives.care.
If you believe someone has accessed your MyDirectives.care account without your permission, or that the security of your account has been compromised, contact MyDirectives Support immediately.
We may send you communications necessary to administer your account or provide the MyDirectives Services, including account verification, security notices, document-related communications, service announcements, and other administrative messages.
Your healthcare decisions belong to you.
MyDirectives.care is designed to help you make, document, manage, and share your ACP documents, but your healthcare decisions are still your responsibility.
MyDirectives.care does not make healthcare decisions for you or direct your healthcare agent or medical teams regarding the decisions they should make.
Advance Directives and Other Advance Care Planning Documents
MyDirectives.care helps you create an advance directive and allows you to upload, securely store, manage, and share other ACP documents, including existing advance directives and portable medical orders like POLST and Do-Not-Resuscitate forms.
You are responsible for reviewing the information contained in documents you create or upload to make sure that information accurately reflects your healthcare decisions.
MyDirectives.care provides information and technology to help you complete your advance directive, but requirements for advance directives vary by state and may change over time.
Depending on applicable law and the document involved, requirements may include signatures, witnesses, notarization, particular forms, or other requirements.
You are responsible for completing and signing your documents in compliance with the laws where you live.
MyDirectives.care Does Not Provide Medical Advice
MyDirectives.care does not provide medical advice, diagnosis, or treatment.
Information available through MyDirectives.care is intended for general educational purposes. It does not replace advice from a qualified healthcare professional.
Healthcare decisions can involve complex medical situations. You should discuss questions about your health, medical condition, treatment options, or the potential consequences of healthcare decisions with a healthcare professional.
Never delay seeking medical care because of information you have read or received through MyDirectives.care.
MyDirectives.care Does Not Provide Legal Advice
MyDirectives does not provide legal advice and is not a law firm or a substitute for an attorney.
Laws governing advance directives, healthcare agents, witnesses, notarization, and other ACP matters vary by jurisdiction.
MyDirectives.care may provide information about requirements applicable to a document, but we do not guarantee that a document created, completed, uploaded, or stored using MyDirectives.care will be legally valid or enforceable in every jurisdiction or situation.
If you have questions about your individual legal situation or need legal advice, you should consult a licensed and qualified attorney.
Remote Online Notarization
MyDirectives.care provides access to Remote Online Notarization (RON) through a third-party partner for individuals who need or choose to have their MyDirectives Advance Directive notarized.
RON is an optional service and may involve an additional fee. Information about the service and applicable fees will be provided before you choose to use it.
When you use RON, you may be required to provide information to the third-party provider for identity verification and notarization. The RON provider may have its own terms of use and privacy policy, and your use of its services may be subject to those terms, policies, and applicable notarization laws.
MyDirectives is not the notary and does not control the independent actions or determinations of a commissioned notary.
Use of RON does not guarantee that an advance directive or other document will be valid or enforceable in every jurisdiction or situation.
Sharing Your Advance Care Planning Documents and Information
MyDirectives.care allows you to share your advance directive and other ACP documents with people you choose, which may include your healthcare agent, alternate healthcare agents, loved ones, caregivers, and healthcare providers.
You are responsible for deciding with whom you directly share your information and documents.
When you provide contact information for another person, such as a healthcare agent, you represent that you have the right to provide that information for purposes related to your advance care planning.
Once information or an ACP document has been shared with or accessed by another person or organization, MyDirectives cannot control how that person or organization subsequently uses, stores, or discloses it.
Making Your Advance Care Planning Documents Available for Healthcare Providers
Creating an advance directive is only part of advance care planning. The document also needs to be available when and where it’s needed.
When you create or upload ACP documents using MyDirectives.care, they are stored in and made available through our national advance care planning document registry, the A|D Vault Exchange™.
MyDirectives’ technology helps authorized healthcare professionals find and access ACP information when needed for your care and as permitted by applicable law.
By using MyDirectives.care, you expressly authorize MyDirectives to store and make your ACP documents and related information available for these purposes, subject to applicable law and our Privacy Policy.
MyDirectives Cannot Guarantee Access to or Use of Your Advance Care Planning Documents
MyDirectives.care is designed to improve the availability of ACP information, but we cannot guarantee that every healthcare professional or healthcare organization will be able to find or access your ACP documents in every situation.
Healthcare organizations use different technologies, participate in different healthcare information networks, and follow their own policies, procedures, and legal requirements.
MyDirectives also cannot guarantee that a healthcare professional or organization will interpret, accept, or act upon an advance directive, portable medical order, or other ACP document in a particular way.
Healthcare professionals remain responsible for making treatment decisions in accordance with applicable law, professional standards, the patient's medical condition, and the information available to them.
You should also share your advance directive with your healthcare agent, loved ones, and healthcare providers and let them know where your current ACP documents can be found.
Keeping Your Advance Care Planning Documents Current
Your health, relationships, priorities, and healthcare decisions will change over time.
MyDirectives may remind you periodically to review your information and documents, but you are responsible for reviewing your advance directive and other ACP documents and updating them when appropriate.
If you create a new advance directive or replace another ACP document, you should make sure your healthcare agent, loved ones, caregivers, and healthcare providers know that you have made a change. You should also give them access to the most current version.
MyDirectives is not responsible for decisions made in reliance on information or documents that you have not kept accurate and current.
Optional Partner Products and Services
MyDirectives may make optional products or services from third-party partners available through or in connection with the MyDirectives Services.
These may include notarization, products related to ACP or emergency preparedness such as medical jewelry, or other products and services that complement MyDirectives.care.
Your use or purchase of a partner product or service is optional and may be subject to separate terms, conditions, fees, warranties, return policies, dispute resolution policies, and privacy policies established by the partner.
When you request a partner product or service, MyDirectives may provide information to that partner as necessary to fulfill your request. We explain our policy regarding providing your information to partners in our Privacy Policy.
Unless otherwise expressly stated, third-party partners are independent from MyDirectives. We do not control and are not responsible for their products, services, acts, omissions, representations, or business practices.
Fees
Creating a MyDirectives.care account and creating, uploading, storing, managing, and sharing your advance directive or other ACP documents through the standard consumer MyDirectives Services is currently provided without charge.
Certain optional products or services, including services provided by third-party partners, may require payment.
Any applicable fees will be disclosed before you choose to purchase or use a paid service.
MyDirectives may introduce, modify, or discontinue products, services, or fees in the future. We will provide appropriate notice of material changes as required by applicable law and these Terms.
MyDirectives’ Privacy Policy and HIPAA Notice
Your use of MyDirectives.care is subject to our Privacy Policy and, where applicable, our HIPAA Notice.
Those notices describe how MyDirectives collects, uses, discloses, stores, and protects information associated with your use of MyDirectives.care and the MyDirectives Services.
By using MyDirectives.care, you expressly acknowledge and agree that your personal information will be handled as described in the applicable privacy notices and as otherwise permitted by law.
Your MyDirectives.care Content and Documents
You retain ownership of the personal information, documents, and other content you provide to MyDirectives using MyDirectives.care.
You give MyDirectives permission to host, store, process, reproduce, transmit, display, and otherwise use that content only as reasonably necessary to provide, operate, secure, and improve the MyDirectives Services, fulfill your requests, and perform activities described in these Terms and our Privacy Policy.
This permission continues for as long as necessary to provide the MyDirectives Services and meet applicable legal, regulatory, contractual, security, and record-retention requirements.
You represent that you have the right to provide or upload content you submit to MyDirectives.care, and that doing so does not violate applicable law or the rights of another person.
MyDirectives’ Acceptable Use Policy
You may use MyDirectives.care only for lawful purposes and in accordance with these Terms.
You will not:
• Use MyDirectives.care to impersonate another person or misrepresent your identity.
• Access or attempt to access another person's MyDirectives.care account without authorization.
• Provide information or content that you know is false, fraudulent, unlawful, or infringes another person's rights.
• Interfere with or disrupt the operation or security of MyDirectives.care.
• Attempt to gain unauthorized access to MyDirectives.care, its systems, networks, accounts, or data.
• Circumvent or attempt to circumvent security or access controls.
• Introduce malware, viruses, malicious code, or other harmful technologies.
• Reverse engineer, decompile, disassemble, or attempt to derive source code.
• Scrape, crawl, data mine, or use automated means to collect information from MyDirectives.care without our express written permission.
• Copy, modify, distribute, sell, sublicense, or commercially exploit MyDirectives.care or our proprietary content without our prior written permission.
• Use MyDirectives.care in any manner that violates applicable law or these Terms.
• Help or encourage another person to do any of these things.
MyDirectives’ Intellectual Property
MyDirectives.care and the software, technology, design, text, graphics, logos, trademarks, service marks, and other content we provide are owned by or licensed to MyDirectives and are protected by applicable intellectual property laws.
Subject to these Terms, MyDirectives grants you a limited, personal, non-exclusive, non-transferable, revocable right to access and use MyDirectives.care and the MyDirectives Services for your personal, non-commercial use.
No rights are granted to you except those expressly stated in these Terms.
MyDirectives®, related names and logos, and other MyDirectives marks may not be used without our prior written permission.
Service Availability
We work to make MyDirectives.care reliable and available, but no technology service can be guaranteed to operate without interruption.
MyDirectives.care may occasionally be unavailable because of maintenance, system failures, telecommunications or Internet problems, cybersecurity events, circumstances involving third-party systems, or other events beyond our reasonable control.
We do not guarantee that MyDirectives.care will always be available, uninterrupted, secure, or error-free.
You are responsible for obtaining the devices, Internet access, telecommunications services, software, and other resources necessary to access MyDirectives.care.
Changes to the MyDirectives Services
We may add, change, improve, suspend, or discontinue features, products, or MyDirectives Services from time to time.
If we make a material change that significantly affects your use of MyDirectives.care, we will provide notice as appropriate or required by applicable law.
MyDirectives is not liable for modifications, interruptions, suspensions, or discontinuation of the MyDirectives Services except to the extent liability cannot be excluded under applicable law.
Suspension or Termination
You may request to close your MyDirectives,care account at any time using the available account management process or by contacting us.
We may restrict, suspend, or terminate access to MyDirectives.care if we reasonably believe you have violated these Terms, used MyDirectives.care or the MyDirectives Services unlawfully, created a security or legal risk, or if suspension or termination is required by law.
Where appropriate, we will provide notice before taking such action, although immediate action may be necessary to protect users, MyDirectives, healthcare information, or the security and integrity of MyDirectives.care and the MyDirectives Services.
Closing or terminating an account does not necessarily require immediate deletion of all information. Certain information may be retained in accordance with our Privacy Policy and applicable legal, regulatory, contractual, security, and record-retention requirements.
Third-Party Websites and Services
MyDirectives.care may contain links to or integrations with websites, products, applications, or services operated by third parties.
Links and integrations are provided for convenience only and do not necessarily mean MyDirectives endorses a third party or its products or services.
We do not control independent third-party services and are not responsible for their availability, content, privacy practices, security, products, services, or actions.
You should review the terms and privacy policies applicable to a third-party product or service before using it.
Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYDIRECTIVES.CARE, THE MYDIRECTIVES SERVICES, AND ANY SERVICES PROVIDED BY EMERGENCY-RELATED SERVICE PROVIDERS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE FULLEST EXTENT PERMITTED BY LAW, MYDIRECTIVES DISCLAIMS IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that MyDirectives.care or the MyDirectives Services will always be available, uninterrupted, error-free, or completely secure.
We do not guarantee the legal validity or enforceability of any advance directive or other ACP document in any particular jurisdiction or circumstance.
We do not guarantee that an advance directive or other ACP document will be located, retrieved, accessed, accepted, interpreted, or followed by a particular healthcare professional or organization.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYDIRECTIVES AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, AND PARTNERS, INCLUDING EMERGENCY-RELATED SERVICE PROVIDERS, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUES, DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE MYDIRECTIVES.CARE OR THE MYDIRECTIVES SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF MYDIRECTIVES AND ANY EMERGENCY-RELATED SERVICE PROVIDER ARISING OUT OF OR RELATING TO THESE TERMS OR THE MYDIRECTIVES SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID DIRECTLY TO MYDIRECTIVES FOR THE MYDIRECTIVES SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not permit certain limitations of liability, so some of these limitations may not apply to you.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless MyDirectives and its affiliates, officers, directors, employees, agents, licensors, and partners, including any Emergency-Related Service Providers, from claims, liabilities, damages, losses, and reasonable costs and expenses, including attorneys' fees, arising from your unlawful use of MyDirectives.care or the MyDirectives Services, content you provide in violation of these Terms, or your material violation of these Terms.
This obligation does not apply to the extent a claim results from the gross negligence, willful misconduct, or violation of law by MyDirectives or any Emergency-Related Service Provider.
Governing Law and Disputes
These Terms and any dispute arising out of or relating to them or your use of MyDirectives.care or the MyDirectives Services will be governed by the laws of the State of Texas, United States of America, and applicable United States federal law, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any cause of action or claim you may have with respect to MyDirectives.care or the MyDirectives Services must be commenced within one year after the cause of action or claim arises.
Any legal action or proceeding arising out of or relating to these Terms or the MyDirectives Services will be brought in a court of competent jurisdiction located in Dallas County, Texas, unless applicable law provides otherwise.
You and MyDirectives consent to the personal jurisdiction of those courts.
Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
MyDirectives may assign its rights and obligations under these Terms in connection with a merger, acquisition, reorganization, sale of assets, change in ownership, or similar transaction, or as otherwise permitted by law.
Entire Agreement and Severability
These Terms, together with the Privacy Policy, the HIPAA Notice, and any other policies or terms expressly incorporated into them, constitute the entire agreement between you and MyDirectives regarding your use of MyDirectives.care and the MyDirectives Services.
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will remain in effect.
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
Changes to These Terms
We may update these Terms from time to time to reflect changes in MyDirectives.care, our business practices, technology, legal requirements, or other circumstances.
When we make changes, we will update the Version Date at the bottom of these Terms.
If changes are material, we may provide additional notice through MyDirectives.care, by email, or through another appropriate method as required by applicable law.
Your continued use of MyDirectives.care after updated Terms become effective constitutes your acceptance of the updated Terms to the extent permitted by applicable law.
If you do not agree to updated Terms, you may stop using MyDirectives.care and request to close your account.
Feedback
We welcome feedback, suggestions, and ideas about MyDirectives.care and the MyDirectives Services.
If you voluntarily provide feedback, you agree that MyDirectives may use it without restriction or compensation to you, including to improve, develop, and promote our products, MyDirectives.care, and MyDirectives Services.
Please do not submit confidential information as feedback unless we have specifically agreed to receive it confidentially.
